You understand and agree that your are joining ScoreSafety to gain access to your credit score, credit reports, credit alerts, and million dollar identity theft protection described on this site. You will be charged $29.95 today to begin your membership.

Your Credit Score is included with your Membership. You can cancel your Membership at any time. You are eligible for a refund within one day of your order if you have not accessed your credit score or credit report. Membership must be cancelled by calling 866-519-6877 and speaking with a Customer Care representative or leaving a voice message with the automated prompts. If you have accessed your credit score or credit report, a refund will not be given. Membership is $29.95 per month. You will be charged $29.95 on the 1st day of each month that extends your membership for another 30 days. You will subsequently be charged $29.95 each month thereafter until you cancel you membership giving you a 24/7 access to your credit score, credit report, credit alerts, and million dollar identity theft protection.

Your Welcome Kit and Activation Code will arrive from info@ScoreSafety.com so please make sure that this address is unblocked. You may call 888-318-1845 with questions about your account.

Acceptance

You hereby accept and agree to be legally bound by these Terms and Conditions ("Terms"). These Terms are effective immediately by You registering ("the Subscription") and using ScoreSafety ("the Service"). You agree to be legally bound by and subject to all terms and conditions contained in these Terms. You represent and warrant that You are at least 18 years old and otherwise legally competent in all respects and possess all legal authority and power to accept and be bound by these Terms. Additionally, You represent and warrant that You are not prohibited under any part of these Terms from registering or signing up with or otherwise subscribing to or receiving any of the Service. You represent and warrant all information provided by You has been and is complete, accurate, and current, and that You shall continue to provide complete, accurate and current information in connection with all registration or renewal processes and further agree to update all such information as necessary to maintain complete, accurate and current information. To update your information you must contact the Service. You understand and agree that in addition to the Terms and Conditions of this site. You will be subject to the Terms and Conditions of the Service.

After reviewing the information you submit, you understand and agree that the Service has a right, at its sole discretion, to refuse your application for a Subscription. Further, you agree that the Service will not be liable to you if the Service, for any reason, refuses your application for a Subscription or suspends or terminates an existing Subscription of yours, or disallows use of, or access to an existing Subscription of yours or any portion thereof.

You understand and agree that by registering you are providing "written instructions" in accordance with the Fair Credit Reporting Act, as amended ("FCRA"), for the Service to obtain information from your personal credit profile from Experian or any other credit reporting company. You authorize the Service to access your credit profile to verify your identity and to provide credit monitoring, credit reporting, credit scoring, credit score monitoring and tracking, identity monitoring, fraud resolution and card registry products. You also authorize the Service to access your credit profile to perform other functions related to providing the product(s) that you have ordered or may order.

Changes to Terms

These terms may be changed at any time with or without notice. Any use of the Service or this Site by You after the altered Terms are posted on this Site, shall constitute Your acceptance of all changes to the Terms. If You do not agree to any such changes, Your sole and exclusive remedy is to cancel Your Subscription.

Automatic Renewal of Subscription

The automatic renewal of your subscription is a courtesy and not an obligation (contractual or otherwise) of the Service, You acknowledge and confirm that the obligation to renew your Subscription is solely and exclusively Your responsibility, and is not the obligation (contractual or otherwise) of this Site. While consenting to the performance of said courtesy, You hereby release this Site from all liability for any failure for any reason of Your Subscription not being renewed. You acknowledge that said subscription if not renewed, for whatever reason, will expire at one minute to midnight on the last day of the current month.

Cancellation of Automatic Renewal of Subscription

To cancel the automatic renewal of Your Subscription You must cancel Your Subscription by calling 1-866-519-6877 anytime prior to next renewal date and request the Service to cancel Your Subscription. No additional charges will be billed to You and Your Subscription shall be cancelled as of the day you call. No refunds will be given.

Proprietary Rights

These Terms do not give You any rights in the intellectual property or technology of this Site. All copy write content is the exclusive property of this site. All trademarks, and logos is the exclusive property of the respective owners.

Security

You have an obligation and duty to maintain and control passwords and access to Your Subscription. You agree to immediately notify the Service by telephone at 866-519-6877 of any unauthorized uses of Your Subscription or any other breaches of security. You understand and agree that this Site will not be liable for any loss or damages of any kind, under any legal theory, caused by Your failure to comply with the foregoing security obligations or caused by any person to whom You grant access to Your Subscription.

ARBITRATION

You understand and agree that all claims, disputes or controversies between you and the Service, shall be resolved by final and binding arbitration at a location determined by the arbitrator. Any controversy concerning whether a dispute is arbitrable shall be determined by the arbitrator and not by the court. The parties voluntarily and knowingly waive any right they have to a jury trial. Judgment upon any award rendered by the arbitrator may be entered by any state or federal court having jurisdiction thereof. The federal arbitration act ("faa") shall prevail in all aspects of this arbitration contract.

YOUR RIGHTS UNDER THE FCRA

You have certain rights under the Federal Credit Reporting Act ( FCRA) which allows you to obtain a copy of all of the information about you from any consumer credit reporting company for a reasonable charge. You must be told if information in your file has been used against you. You have the right to know what is in your file. You may request and obtain all the information about you in the files of a consumer-reporting agency (your “file disclosure”). You will be required to provide proper identification, which may include your Social Security number. You are entitled to a free file disclosure if:

  • A person has taken adverse action against you because of information in your credit report.
  • You are the victim of identify theft and place a fraud alert in your file.
  • Your file contains inaccurate information as a result of fraud.
  • You are on public assistance.
  • You are unemployed but expect to apply for employment within 60 days.

You are entitled to one free disclosure every 12 months upon request from each nationwide credit bureau and from nationwide specialty consumer reporting. You have the right to ask for a credit score, but you will have to pay for it. You have the right to dispute incomplete or inaccurate information. Consumer reporting agencies must correct or delete inaccurate, incomplete or unverifiable information. Consumer reporting agencies may not report outdated negative information. A consumer-reporting agency may provide information about you only to people with a valid need.

The disclosure report as required by FCRA must be obtained directly from the consumer-reporting agency that maintains your credit history on file.

ScoreSafety and its benefit providers are not credit repair service providers and do not receive fees for such services, nor are they credit clinics, credit repair or credit services organizations or businesses, as defined by federal and state law.

DESCRIPTION OF THE SERVICE

ScoreSafety provides public record information ("the Service") using a variety of personal information suppliers, technologies and public information databases ("Third Parties"). You hereby authorize and instruct The Wisdom Companies to act as your agent by accessing and using any available online searchable databases on your behalf for the purpose of obtaining and gathering personal information about yourself for your use and benefit, and to request removal of your personal information from databases if you direct us to.

ScoreSafety MILLION DOLLAR GUARANTEE & SERVICE LIMITED WARRANTY PROVIDED THROUGH CHARTIS

Limited Warranty: ScoreSafety warrants to You that the Service You receive will perform substantially in accordance with any written specifications provided to You by ScoreSafety during the entire term of Your subscription ("Warranty").

Remedy: IF THE SERVICE FAILS TO COMPLY WITH THE WARRANTY, ScoreSafety SHALL: (I) USE COMMERCIALLY REASONABLE EFFORTS TO CORRECT THE FAILURE; AND IF (AND ONLY IF) YOU SUFFER A STOLEN IDENTITY EVENT (AS DEFINED BELOW) AS A DIRECT RESULT OF SUCH FAILURE, (II) PROVIDE YOU WITH THE BENEFITS AND RESTORATION SERVICES (BOTH AS DEFINED BELOW).

STOLEN IDENTITY EVENT

A "Stolen Identity Event" means the theft or Your personal identification, social security number, or other method of identifying You, which has or could reasonably result in the wrongful use of such information, including, but not limited to stolen identity events occurring on or arising out of your use of the internet. All loss resulting from Stolen Identity Event(s) and arising from the same, continuous, related or repeated acts shall be treated as arising out of a single stolen identity event occurring at the time of the first stolen identity event. Stolen identity event shall not include the theft or unauthorized or wrongful use of Your business name, d/b/a or any other method of identifying any business activity of yours.

YOUR SOLE REMEDY, AND THE EXCLUSIVE LIABILITY OF ScoreSafety FOR ANY VIOLATION OF THE WARRANTY IS THE FOLLOWING: BENEFITS ScoreSafety shall reimburse You for only the following ("Benefits"):

Costs
  • Necessary costs incurred by You in the United States for re-filing applications for loans, grants or other credit instruments that are rejected solely as a result of a Stolen Identity Event.
  • Necessary costs incurred by You in the United States for notarizing affidavits (or other similar documents), and long distance telephone calls and postage, incurred solely as a result of Your efforts to report a Stolen Identity Event and/or amend or rectify records as to Your true name or identity as a result of a Stolen Identity Event.
  • Necessary costs incurred by You for up to six credit reports from established credit bureaus dated within twelve (12) months after You become aware of a Stolen Identity Event.
Lost Wages
  • Actual lost wages that would have been earned in the United States, whether partial or whole days, for time reasonably and necessarily taken off from work and away from your work premises solely as a result of Your efforts to amend or rectify records as to Your true name or identity as a result of a Stolen Identity Event. Actual lost wages includes remuneration for vacation days, discretionary days, floating holidays, and paid personal days and excludes business interruption or future earning of a self-employed professional.
  • Computation of lost wages for self-employed professionals must be supported by and will be based on prior year tax returns. Self-employed individual means a person who owns or operates his or her own business or trade and whose primary income is earned from such business or trade. Coverage is limited to wages lost 12 months after your discovery of a stolen identity event.
Legal Defense Fees and Expenses

Reasonable and necessary fees and expenses incurred in the United States by You (after obtaining ScoreSafety's express prior written consent) for an attorney expressly approved by ScoreSafety in writing for (and only for):

  • Defending civil suits brought against You by a creditor or collection agency or entity acting on behalf of a creditor for non-payment of goods or services, or default on a loan, directly resulting from a Stolen Identity Event; and Removing any civil judgment wrongfully entered against You as a result of the Stolen Identity Event.
  • Criminal defense for charges brought against you as a result of the stolen identity event. However, we will only pay for this after it has been established by acquittal or dropping of charges because you were not in fact the perpetrator.
Restoration Services

ScoreSafety shall provide to You only the following restoration services ("Restoration Services"):

  • Providing You with an information package including a description of the resolution process, educational articles, and guidance for avoiding future complications ("ScoreSafety Claims Kit").
  • Reviewing Your credit files with You to determine the accuracy of the file and potential areas of fraud.
  • Notifying (as needed) Your affected creditors, financial institutions, credit card companies, utility providers, and merchants of the identity fraud.
  • Providing information to the Federal Trade Commission (FTC), and to other government agencies as appropriate.
  • When appropriate, providing assistance with obtaining and reviewing Your Social Security Personal Earnings and Benefits Statement.
  • Creating and maintaining a case file to document the identity fraud.

Restoration Services will only be performed by ScoreSafety after ScoreSafety's receipt from You of written authorization to undertake such services. Restoration Services are subject to ScoreSafety's standard practices and procedures and may be modified by ScoreSafety at anytime time (including, without limitation, as ScoreSafety deems reasonably necessary given the nature of the applicable Stolen Identity Event).

WARRANTY LIMITS

NOTWITHSTANDING ANYTHING TO THE CONTRARY, THE AMOUNTS EXPENDED BY ScoreSafety (INCLUDING, WITHOUT LIMITATION, AMOUNTS REIMBURSED TO YOU) UNDER THIS LIMITED WARRANTY SHALL NOT EXCEED, IN THE AGGREGATE, US$ 1,000,000 FOR ALL STOLEN IDENTITY EVENTS (REGARDLESS OF THE CIRCUMSTANCES, INCLUDING, WITHOUT LIMITATION, YOUR OWNERSHIP OR USE OF MULTIPLE SUBSCRIPTIONS TO THE SERVICE) ("WARRANTY LIMIT").

WARRANTY CONDITIONS AND EXCLUSIONS

This Limited Warranty provides benefits to You for a Stolen Identity Event only if:

(i) You report such Stolen Identity Event to ScoreSafety at 866-519-6877 as soon as You become aware of such event, but no later than three (3) months after the Stolen Identity Event occurs. (ii) You strictly follow all instructions set forth in the ScoreSafety Claims Kit, and otherwise provided to You by ScoreSafety for such Stolen Identity Event. These instructions may require You to, among other things, notify major credit bureaus, the Federal Trade Commission's Identity Theft Hotline and appropriate law enforcement authorities of such Stolen Identity Event. (iii) At the time of the Stolen Identity Event and Your discovery of such event, You are a current, registered subscriber to the Service ("Subscriber"). For clarity, You will not have the right to receive any Benefit with respect to Stolen Identity Events that occur prior to the time You are a Subscriber, or that are discovered by You after You are no longer a Subscriber. (iv) You are otherwise in full compliance with all other terms and conditions for use of the Service (including, without limitation, the term of use located at ScoreSafety.com/terms-and-conditions). If ScoreSafety finds that You misrepresented any information required by ScoreSafety to provide the Benefits, or misrepresented that You were Subscriber when Your information was misused, or misrepresented any information required for You to become Subscriber, You agree to promptly reimburse ScoreSafety for any amounts ScoreSafety has paid in connection with Your Benefits claim, including, without limitation, any costs ScoreSafety incurs to collect such amounts from You. If You are found, or ScoreSafety reasonably believes you are, (i) guilty of a crime related to any loss which You attribute to identity theft, or (ii) otherwise responsible for the Stolen Identity Event, ScoreSafety shall be entitled to recover all Benefit amounts paid on Your behalf with respect thereto.

Disclaimer; Additional Terms: EXCEPT AS EXPRESSLY SET FORTH IN THIS LIMITED WARRANTY, NEITHER ScoreSafety NOR ANY OF THEIR RESPECTIVE SUPPLIERS OR VENDORS MAKES ANY WARRANTY (EXPRESS OR IMPLIED) WITH RESPECT TO THE SERVICE, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE. IN THE EVENT THAT ANY OF THE PROVISIONS OF THIS LIMITED WARRANTY SHALL BE HELD BY A COURT OR OTHER TRIBUNAL OF COMPETENT JURISDICTION TO BE ILLEGAL, INVALID OR UNENFORCEABLE, SUCH PROVISIONS SHALL BE LIMITED OR ELIMINATED TO THE MINIMUM EXTENT NECESSARY SO THAT THIS LIMITED WARRANTY SHALL OTHERWISE REMAIN IN FULL FORCE AND EFFECT.
